RESERVATIONS & PAYMENT:
- Initial payment (1/2 of the base rental rate) is due upon receipt of the signed rental agreement. Rental agreement should be returned to Paradise Properties within 3 days of booking or the reservation will be canceled. The remaining balance is due thirty (30) days prior to check in date without exception. Payment may be made by Guest by check or any major credit cards. A $75 fee will be charged for any returned checks.
- Reservations must be made and confirmed by an adult over the age of twenty five (25). This policy includes reservations made by parents who do not check-in and/or who leave overnight during confirmed rental period. An adult over the age of twenty five (25) must be present at the Property for the entirety of the confirmed rental period. Violators will be evicted, and all rental payments will be forfeited.
ARRIVAL/DEPARTURE & OCCUPANCY:
- The Guest(s) acknowledges and understands that check-out time is no later than 10:00 AM CST and check-in time is no earlier than 4:00 PM CST. If Guest(s) checks out later than 10:00 AM CST, Guest(s) will be charged an additional night at the standard rate. If Guest(s) checks in earlier than 4:00 PM CST, without management approval, Guest(s) will be charged an additional $150.
- Paradise Properties provides Guest(s) with startup toiletries to include 2 toilet paper rolls per bathroom, 1 paper towel roll, 1 soap per sink and wash station, and 1 trash can liner per trash can. Guest(s) are responsible for extra items that are not provided in the unit (i.e. extra towels, toiletries, paper products, including trash can liners etc.).
- The Property shall not be used for parties/weddings nor be used for social gatherings that exceed maximum occupancy as advertised for the Property or as otherwise advised by Paradise Properties. Nor shall the Property be used as a place of commerce or for any illegal activity. Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents. Paradise Properties has the prerogative to terminate this agreement and to ask disruptive Guest(s) to vacate the premises immediately with no refund.
- Guest(s) shall make the Property available to Paradise Properties for purposes of making repairs or for other scheduled purposes. Paradise Properties may enter the Property in cases of emergency, without notice to Guest(s).
- Guest(s) shall start dishwasher prior to checking out (if applicable), gather towels in pile (keep damp towels separate), and take trash out before leaving. Guest(s) shall dispose of garbage according to the weekly schedule for the Property for garbage removal. In the event that the garbage is not removed due to negligence on the Guest’(s’) part, Guest(s) shall pay for the service cost to remove garbage.
PROPERTY/ UNIT USAGE & MAINTENANCE:
- It is understood that each unit is privately owned including the furnishings, with Paradise Properties Vacation Rentals & Sales solely as” Agent” for the Owner. Information regarding individual listings is believed accurate but cannot be guaranteed. Guest(s) inspection of the premises is encouraged.
- Guest(s) shall be solely responsible for any property damage, accidents, injury to any person or loss sustained by any person, including: loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guest(s) use of the Property or the items of personal property provided by Paradise Properties or Owner at guest(s) request. Guest(s) shall inspect and be familiar with proper use and application of such items prior to using them. Guest(s) hereby agrees to INDEMNIFY and hold Paradise Properties and/or Owner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of the Property or the items of personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold Owner and its agents harmless with respect there to.
- Guest(s) shall leave the Property in a clean, presentable and undamaged condition prior to check-out. If there are any missing items or damaged items found during the inspection after Guest(s) checks out of the Property, Guest(s) understands that Paradise Properties reserves the right to charge Guest(s) for any repairs, items that need replacing or additional cleaning fees.
- If the Property is not equipped with an address, Guest(s) understands that the 911 address will be provided with this Agreement and/or posted on the refrigerator or other readily identifiable location within the Property.
- Wireless internet is provided in the rental and the service level has been chosen by the Owner. No refund of rents shall be given for outages, content, lack of content or personal preferences with regard to TV and internet services.
- Guest(s) understands that the linen count will be as follows; 2 hand towels per bathroom and 1.5 bath towel per Property sleeping capacity as advertised, 1 wash cloth are provided per person the Property accommodates. Be sure to pack extra linens if you feel you need more than what is provided. Sheets are provided per bed.
DOG GUIDELINES:
- No pets are permitted on the Property except as provided herein. Dogs are not permitted on the Property without written approval of Paradise Properties. If this policy is violated, Guest(s) will be vacated immediately without refund and charged an additional $1000 dog fee. If it is found that a pet that was not permitted was on site, Guest(s) may incur additional cleaning fees. For properties that dogs are allowed, a nonrefundable dog fee will be charged per dog, and Guest(s) hereby agrees to comply with the following: It is expected that Guest(s) will clean up after dog inside the Property, outside in yard, and surrounding premises. The Property should be left in an orderly manner with excessive dog hair cleaned up prior to departure. Guest(s) will pay a dog fee in the amount specified for the Property. All dogs must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest(s) upon request):
- May not exceed fifty (50) lbs unless otherwise approved by Paradise Properties.
- Must be at least one (1) year of age or older unless otherwise approved by Paradise Properties.
- Must be spayed or neutered.
- Must be up-to-date on rabies and all other vaccinations, and flea and tick prevention medication.
All dogs must be leashed at all times. Dogs are not allowed on furniture at any time. Any evidence of dogs on furniture may incur additional cleaning fees. Dogs must not cause damage to premises or furnishings. If damages are caused, the cost of the damage will be charged to Guest(s) credit card on file. Guest(s) should prevent dogs from producing excessive noise at a level that disturbs neighbors. If dogs are left unattended in the Property, dogs must be crated. Dogs will not be left unattended for an undue length of time, either indoors or out. Dogs will not be left unattended on balcony, patio, or porch. Owner and/or Paradise Properties assumes no responsibility for illness or injury that may incur to dogs or humans while on the premises. Guest(s) shall be solely responsible for the dogs while on the Property.
GENERAL GUIDELINES & POLICIES:
- All Paradise Properties-managed properties are non-smoking properties. If it is found that Guest(s) has been smoking during their stay in the Property, their reservation will be charged an additional $500.
- Guest(s) agrees that anyone using drugs or allowing others to use drugs or any illegal or unlawful controlled substance on the Property will be immediately denied occupancy of the Property and required to immediately vacate the Property.
- Due to Florida climate the thermostat shall not be set below 70 degrees. If set below 70, especially with doors and windows open the AC will freeze. Guest(s) will be held responsible for the maintenance bill if the AC stops working due to negligence of lowering AC temperature and keeping windows and doors open.
- In rare instances, Paradise Properties has been in a position where a reserved property has become unavailable; therefore Paradise Properties reserves the right to cancel your reservation with a full refund.
- If Guest(s) personal belongings are left behind and not claimed within thirty (30) days, they will be discarded.
- The Florida Fire Code: NFPA 1:10.11.7 states for other than one- and two-family dwellings, no hibachi, gas-fired grill, charcoal grill, or other similar devices used for cooking, heating, or any other purpose, shall be used or kindled on any balcony or under any overhanging portion or within 10 ft. (3 m) of any structure.
- Due to HOA and community restrictions, parking is limited at the Property. No boats, RV, trailers, jet skis or other recreational vehicles are allowed at the Property. If this policy is violated, Guest(s) will be charged $500 and any such vehicle will be towed.
- Please make sure to remove any and all items from the beach each evening. Officers of the County will be patrolling the area, throwing out anything they find as part of the “Leave No Trace” Program. Leaving things on the beach disturbs the nesting Sea Turtles in our area. Also, please fill in any holes dug on the beach as these are detrimental to the Sea Turtles nesting and hatching. It is unlawful to walk on any sand dunes or pick sea oats.
Amenity rentals for our guests may be provided by Paradise Properties and other third party vendors, which are separate entities. Reserving bikes, golf carts, and beach chairs can be coordinated through Paradise Properties.
Amenity Rental Agreement–This agreement does not require Guest(s) to purchase amenities from our vendors.
Note: Upon request, baskets and combination bike locks are provided at no rental charge upon request for Guest(s). Guest(s) are required to bring their own helmets to guarantee proper size/fit.
- Any rental equipment (i.e. beach chairs, golf carts, appliances, machinery, supplies, etc.) and other equipment as a result of using amenity services (i.e. bonfires, tables, chairs, catering, festival tickets, concerts, etc.) provided and scheduled by Paradise Properties, are the sole responsibility of the Guest(s) during the entire length of Guest(s)’ stay at the Property. It is the Guest(s)’ responsibility to follow all Florida statutes rules and regulations regarding use and the return of rental equipment during their rental period. Guest(s) are expected to demonstrate care and diligence of all rental equipment, and other equipment and return the rental equipment in the same condition and usage as when they received it. In the event that the rental equipment and other equipment, provided by Paradise Properties or on behalf of third party or affiliated party, is lost, stolen or damaged beyond repair, Guest(s) are solely responsible for the full replacement of rental equipment and other equipment.
- Guest(s) accept use of the equipment listed on this form and, exercises free choice to participate voluntarily in these activities, and promises to take due care during such participation. Guest(s) accept full responsibility for the care and use of this equipment. Guest(s) understand these activities are potentially hazardous activities. Guest(s) understand that the use of this equipment involve a risk of serious bodily injury, or death, as a result of accidents, equipment failures, or other causes. Guest(s) agree to not use any rented/supplied equipment under the influence of alcohol, drugs, or any mind altering substance. Guest(s) hereby agree to freely and expressly assume and accept any risks and all injury to self, personal property and any others injured or damaged as a result of use of this equipment. Guest(s) understand that protective gear such as helmets, life jackets, and gloves are recommended, but they do not eliminate the risk of injury in the event of an accident. Further, Guest(s) hereby indemnify and hold harmless, Paradise Properties and other thirty party vendors, and its members, officers, agents, employees and any other persons or entities acting on its behalf, and the successors and assigns for any and all of the aforementioned persons and/or entities, against any and all claims, demands and causes of action whatsoever, whether presently known or unknown, of any person who suffers any injury, disability, death or other harm, to person or property or both, as a result of participation in and/or use of aforementioned rental equipment. THERE IS NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE and this equipment is accepted “AS IS.”
- Guest(s) agree to follow all state, local, and federal laws pertaining to the lease, riding, and usage of rental equipment, and other equipment during my rental period. Guest(s) agree that Guest(s) are solely responsible and will not hold Paradise Properties or third party vendors liable for any fines incurred by Guest(s) for violations while using any rental equipment.. Pursuant to Florida Statute 316.2065, a bicycle operated between sunset and sunrise must be equipped with a lamp on the front exhibiting a white light visible from 500 feet to the front and both a red reflector and a lamp on the rear exhibiting a red light visible from 600 feet to the rear. Please be advised that the safety and lighting equipment required by Florida law is not provided as part of your bicycle rental. As such, Guest(s) are advised to ride bicycle only between sunrise and sunset. Should Guest(s) choose to ride bicycle after dark, Guest(s) are responsible for obtaining the necessary safety and lighting equipment to comply with Florida law. Compliance with laws and safe riding is the responsibility of each rider. Paradise Properties is not responsible for providing lighting equipment with bicycle and is not responsible for Guest(s) safety should Guest(s) choose to ride after dark.
- If provided by Paradise Properties, Guest(s) agrees to notify Paradise Properties of any and all repairs that the rental equipment needs at check in. The equipment, at all times, remains the exclusive property of Paradise Properties or other third party vendor. Guest(s) are responsible for damage to or loss of the equipment. If the equipment is lost, destroyed or damaged beyond repair in the judgment of Paradise Properties, Guest(s) agrees to pay Paradise Properties the full replacement value of the equipment plus two (2) week’s lost rental income for the equipment The replacement value of the equipment shall be: (1) any bicycle is $600 per bicycle; (2) $30 for any bicycle lock, and; (3) $25 for any bicycle basket. All repairs needed as a result of damage of the equipment will be performed at the normal labor rates and the cost of such repairs, including all parts and/or labor, shall be paid by Guest(s). Guest(s) agrees and understands rental equipment maintenance and repair, by third party vendors, will occur during normal business hours: Monday – Saturday, 9 AM – 5 PM CST. Paradise Properties also reserves the right to charge a finder’s fee if rental equipment is lost or stolen and Paradise Properties locates the rental equipment and returns the rental equipment back to the Property and/or Guest(s).
CANCELLATION/ INSURANCE/PROTECTION PLAN:
- Paradise Properties will not provide a refund, for any reason, for the rental of the Property. If Guest(s) have concerns, please contact Paradise Properties to see about purchasing travel insurance.
- Paradise Properties does offer travel insurance through Generali Global Assistance and by signing this rental agreement, Guest(s) confirms that they have been notified and been given the option to purchase travel insurance, which is 6.95% of the total rate. If Guest(s) would like more information about coverage, please contact Generali at (800) 874-2442 or go to www.generalitravelinsurance.com and click on CONTACT US. Please call Paradise Properties at 850-588-7136 to add travel insurance to current reservation, if applicable.
- Guest(s) gives permission to Safely Stay, Inc. to verify identity, and check criminal databases in order to confirm reservation. Complete terms regarding Safely’s guest verification can be found at www.safelystay.com/terms. Please contact Safely at Concierge@Safely.ai, or go to www.Safely.ai, with any questions. Paradise Properties may deny renting the Property to any potential Guest(s) on the basis of the results of any such identity verification or background check.
- The Safely Stay, Inc. Trust and Safety Fee for most three bedroom homes and larger includes up to $10,000 of accidental coverage for contents damage and up to $100,000 coverage for accidental property damage and bodily injury. Complete terms regarding the Trust and Safety coverage can be found at www.safely.ai/paradise30a. For most smaller properties, there is $1,500 coverage for contents damage. Complete terms regarding the smaller coverage can be found at www.safely.ai/paradiseproperties. Any deductible or minimum claim amount will be the responsibility of the Guest(s), and Paradise Properties will process using the form of payment on file for Guest(s).
- All property damages must be reported to Paradise Properties when they occur. Failure to promptly report damage to Paradise Properties voids this protection.
Paradise Properties shall have sole administrative authority of this plan and shall have the sole exclusive right to determine the extent of repairs necessary as a consequence of Guest(s) negligence. This does not apply to damages caused by the intentional acts of Guest(s), the willful conduct or misconduct of a Guest(s), the gross negligence of a Guest(s), or any instance of theft. Paradise Properties is authorized to charge the Guest(s) credit card for any damages suffered as a result of conduct or misconduct detailed in this paragraph. This protection does not apply to damages/losses caused by pets or smoking in the Property.
Disclaimer for Reservations:
- Guest(s) hereby acknowledges that Paradise Properties is not accountable for status or accessibility for any restaurants, shops, leisure entertainment, businesses or beaches during Guest(s)vacation rental. Guest(s) also understand that Paradise Properties is not responsible for any virus or illness contracted before, during or after Guest(s) vacation rental stay. Guest(s) further acknowledge that due to supply shortages, Paradise Properties may not be able to stock the Property with the customary set of starter amenities as described in this rental agreement above, so Guest(s) may need to bring/purchase these items.
- Guest(s) have had sufficient time to read, review and seek explanation of the provisions contained above, and understand them fully and agree to be bound by them. After careful deliberation, Guest(s) voluntarily give consent and agree to the terms and conditions set forth above. This document constitutes the final and entire agreement between Paradise Properties or other third party vendor and the undersigned. These third party vendors provide no warranties express or implied. In any litigation, arbitration or other proceeding by which one Party either seeks to enforce its rights under this Agreement (whether in contract, tort or both) or seeks a declaration of any rights or obligations under this Agreement, the prevailing party shall be awarded its reasonable attorney fees, and costs and expenses incurred. The validity, interpretation and enforcement of this Agreement and all documents delivered in connection herewith shall be governed by the laws of the State of Florida without regard to choice of laws principles. Whenever possible, each provision of this Agreement shall be interpreted in such manner so as to be effective and valid under applicable law, but if any provision of this Agreement is held to be prohibited by or valid under any applicable law, such provision shall be ineffective only to the extent of such prohibition or invalidity, without invaliding or otherwise rendering ineffective any other provision in this Agreement.
